OLIVER COUNTY PLANNING & ZONING Commission was called to order at 7:00 pm.

The Pledge of Allegiance was recited.

Roll Call was held. Members present were Jody Reinke, Bill Breimeier, Cassie Smith, Linda Nelson, Gary Price, Troy Hatzenbihler and Matt Wilkins. Others present were Jaden Schmidt, Secretary/P&Z, Patty Koapke.

Bill Breimeier moved and Linda Nelson seconded the motion to approve the agenda. All in favor, none opposed; motion carried.

Jody Reinke moved and Linda Nelson seconded the motion to approve the February 26, 2026 meeting minutes. All in favor, none opposed; motion carried.

Discussion was held on the Wind Energy Facility Ordinance Amendments for a one-mile setback for turbines from a non-participating residence and for a cap on turbines in the county.

Comments were received by Tim Doll, Dan Bueligan, Jonathan Dagley, Ryan Fleck, Chris Albers, Arlo Bakker, Marcelle Grosz, Brian Letzring, Michael Doll, Katie Henke-Simon, Greg Maier, Nathan Dagley, Aaron Hintz, Sarah Montone, Briana Scheid, Jodi Hintz, Wes Klein, and Rick Aaser.

Cassie Smith moved and Linda Nelson seconded the motion to move the ordinance amendment for the one-mile setback from non-participating residences to a public hearing/first reading. A roll call vote was held: Bill Breimeier – Nay, Cassie Smith – Aye, Gary Price – Aye, Jody Reinke – Nay, Troy Hatzenbihler – Nay, Linda Nelson – Aye, Matt Wilkins – Aye. The motion carried and the amendment will move forward for a public hearing.

Discussion was held on the Public Hearing/Avoidance Zone amendment language.

Comments were received by Erik Edison and Jonathan Dagley.

Cassie Smith moved and Gary Price seconded the motion to move the ordinance amendment for the public hearing/avoidance zone language to a public hearing/first reading. Troy Hatzenbihler moved to amend the motion and Linda Nelson seconded to clarify all industry that would fall under this amendment at the public hearing. A roll call vote was held: Linda Nelson – Aye, Gary Price – Aye, Bill Breimeier – Aye, Jody Reinke – Nay, Cassie Smith – Aye, Troy Hatzenbihler – Aye. The motion carried and the amendment will move forward for a public hearing. 

An update was given on the Data Center/Cryptocurrency Mining Facilities ordinance work.

Due to lack of proper publication, the DAC/Co2 ordinance reading was moved to the April 30th meeting.

Discussion was held on permit fees for Conditional Use Permits and Building Permits. It was tabled until the next meeting for further discussion.

Discussion was held on the Comprehensive Plan. SRF Consulting has finalized the plan and it is ready to move forward for reading and hearing. Due to an influx of agenda items, the hearing and reading will be moved to June.

The meeting was adjourned at 8:55 pm.

The next meeting for the Oliver County Planning & Zoning Board will be April 30th, 2026 at 7:00 pm in the Oliver County Courthouse Meeting Room.
