OLIVER COUNTY PLANNING & ZONING Commission was called to order at 7:00 pm. Members present were Randy Schmidt, Lonnie Henke, Wyman Scheetz, Raymond Schmidt, Corey Hintz, Jaden Schmidt (Secretary) and Patty Koapke.
The Pledge of Allegiance was recited.
Wyman Scheetz moved and Randy Schmidt seconded the motion to approve the agenda. All in favor, none opposed; motion carried.
Lonnie Henke moved and Raymond Schmidt seconded the motion to approve the minutes from the November 16th and December 14th meeting
A Conditional Use Permit for LCC Telecom/Vertical Bridge was presented to the board. The Chair asked for a letter of written evidence of approval by the landowner from the company. One was provided. Mike Bieniek, a rep for LCC Telecom was present to discuss the permit. Raymond Schmidt moved and Wyman Scheetz seconded the motion to recommend approval to the County Commissioners. A roll call vote was held: Randy Schmidt, Aye, Lonnie Henke, Aye, Wyman Scheetz, Aye, Raymond Schmidt, Aye. The motion carried and the permit was recommended approved.
The Carbon Sequestration Ordinance Amendment Hearing was held. Randy Schmidt moved and Lonnie Henke seconded the motion to open the floor for public comment. All in favor, none opposed; motion carried. The floor was open to public comment.
Shannon Mikula, Minnkota/Grand Forks, addressed the board and provided a packet of documents with comments on the proposed amendment.
Lanny Kenner, Bismarck, addressed concerns.
Tim Doll, New Salem/Oliver County resident, requested there be a larger set back for residences.
Mikael Schmidt, Center/Oliver County, requested that a bond be required to help repair county roads. He also stated that a PHMSA letter did state that counties can have ordinances in place.
Jeff Skaare, Summit Carbon/Dickinson, addressed the board with comments about NDCC regulations, citing 49-22 and 38-22.
Jay Volk, Summit/Bismarck, addressed the board about the financial benefits the county may receive.
Alan Maize, Oliver County, addressed the board about safety recommendations for the ordinance.
Lonnie Henke moved and Raymond Schmidt seconded the motion to close the floor to public comment. All in favor, none opposed; motion carried.
Wyman Scheetz moved and Randy Schmidt seconded the motion to table the ordinance amendment. All in favor, none opposed; motion carried.
Lonnie Henke moved and Raymond Schmidt seconded the motion to table permit fee discussions. All in favor, none opposed; motion carried.
The 2024 Planning & Zoning calendar was presented. Raymond Schmidt moved and Lonnie Henke seconded the motion to approve the calendar. All in favor, none opposed; motion carried.
Meeting was adjourned at 9:30 pm. The next meeting of the Oliver County Planning & Zoning Board will take place on January 25th at 7:00 PM in the Oliver County Courthouse meeting room.
