OLIVER COUNTY PLANNING & ZONING Commission was called to order at 7:00 pm. Members present were Randy Schmidt, Lonnie Henke, Jayar Kindsvogel, Corey Hintz, Jody Reinke, Bill Breimeier, Linda Nelson, Jaden Schmidt (Secretary) and Patty Koapke.
The Pledge of Allegiance was recited.
Bill Breimeier moved and Linda Nelson seconded the motion to approve the agenda.
Jayar Kindsvogel moved and Jody Reinke seconded the motion to approve the February 22nd, 2024 minutes. All in favor, none opposed; motion carried.
Lonnie Henke addressed a conflict of interest with an agenda item: He is within the NextEra/Oliver IV wind project. Jayar Kindsvogel moved and Jody Reinke seconded the motion to allow Lonnie Henke to discuss and vote on agenda items. All in favor, none opposed; motion carried.
Jayar Kindsvogel addressed a conflict of interest with an agenda item: Jayar owns and operates Center Machine, which may stand to benefit from the NextEra/Oliver IV wind project. Jody Reinke moved and Lonnie Henke seconded the motion to allow Jayar Kindsvogel to discuss and vote on agenda items. All in favor, none opposed; motion carried.
Conditional Use Permit #1030 for Beth Kohler was presented. Beth Kohler is proposing to move a home on to and possibly build other outbuildings on property currently zoned agricultural. Bill Breimeier moved and Lonnie Henke seconded the motion to approve Conditional Use Permit #1030. All in favor, none opposed; motion carried.
Building Permit #1031 for Beth Kohler to move a house located at 22-143-83 was presented. Jayar Kindsvogel moved and Jody Reinke seconded the motion to approve building permit #1031. All in favor, none opposed; motion carried.
Building Permit #1032 for Beth Kohler to build a shop located at 22-143-83 was presented. Jody Reinke moved and Lonnie Henke seconded the motion to approve building permit #1032. All in favor, none opposed; motion carried.
Building Permit #1033 for Blattner Energy and the construction of the 73 wind turbines for NextEra/Oliver IV was presented. Linda Nelson moved and Jody Reinke seconded the motion to approve building permit #1034 for Blattner Energy. All in favor, none opposed; motion carried.
Building Permit #1034 for Northwest Contracting Inc., for an addition to a BNI Cold Storage Shed. Lonnie Henke moved and Jayar Kindsvogel seconded the motion to approve building permit #1034 for Northwest Contracting Inc. All in favor, none opposed; motion carried.
Dan and Deb Bueligan requested an extension of Building Permit #1002, issued on June 1, 2023. Lonnie Henke moved and Jayar Kindsvogel seconded the motion to approve the extension. All in favor, none opposed; motion carried.
The Ordinance Amendment Hearing for Section 17.1 was opened. The Amendment would change wording to the Administration portion of the Ordinance in relation to job duties of the Planning & Zoning Department as well as the County Auditor.
Jayar Kindsvogel moved and Lonnie Henke seconded the motion to approve the ordinance amendment.
Discussion and questions were brought up.
Darrell Berger asked when a new auditor comes in to office, if they would take on the duties the amendment is giving that position. The discussion was held that if a new auditor comes into office, they would either be given those duties, as they are required by NDCC to be at the meetings as secretary, or the ordinance could be amended again.
Dan Bueligan commented that with the prior Land Use Administrator, presence and communication was difficult. The change that happened with Patty Koapke and Jaden Schmidt taking on the duties and responsibilities of the Planning & Zoning Department has been a positive change.
A roll call vote was held with all members voting in the affirmative. The Ordinance Amendment to Section 17.1 was passed.
