OLIVER COUNTY PLANNING & ZONING Commission was called to order at 7:00 pm. Members present were Randy Schmidt, Lonnie Henke, Jayar Kindsvogel, Corey Hintz, Jody Reinke, Bill Breimeier, Linda Nelson, Jaden Schmidt (Secretary/P&Z Department) and Patty Koapke (P&Z Department).

The Pledge of Allegiance was recited.

Jody Reinke made a motion to move the Planning & Zoning Board into executive session, with the reason stated that it was based on the recommendation of the County Commission Chair and the State’s Attorney. Lonnie Henke seconded the motion. A vote was held, with all members voting aye. The motion carried and the board was moved into Executive Session at 7:03 pm.

The meeting was called back into session at 7:30 pm.

Jody Reinke made a motion to amend the agenda to remove the CO2 Sequestration discussion with Brian Bitner and Curt Jundt and to also remove the CO2 Sequestration Ordinance Amendment Hearing. Lonnie Henke seconded the motion. All in favor, none opposed; motion carried.

Jayar Kindsvogel moved and Jody Reinke seconded the motion to approve the minutes of the April 25th meeting. All in favor, none opposed; motion carried.

Conflict of Interest Votes were held.

Lonnie Henke expressed a conflict, stating he has an exercised option with NextEra. Jayar Kindsvogel moved and Jody Reinke seconded the motion to allow Lonnie Henke to discuss and vote on agenda items.  All in favor, none opposed; motion carried.

Jayar Kindsvogel expressed a conflict, stating he owns Center Machine and may stand to benefit from potential work from agenda items. Jody Reinke moved and Bill Breimeier seconded the motion to allow Jayar Kindsvogel to discuss and vote on agenda items. All in favor, none opposed; motion carried.

Building Permit #1036 for Mark Albers for an addition to his home was presented. Lonnie Henke moved and Linda Nelson seconded the motion to approve Building Permit #1036. All in favor, none opposed; motion carried.

Building Permit #1037 for Brink Construction for the NextEra Substation concrete foundation pads was presented. Jayar Kindsvogel moved and Linda Nelson seconded the motion to approve Building Permit #1037. All in favor, none opposed; motion carried.

Building Permit #1038 for Atwell for 5 Transmission Line Poles for the NextEra substation was presented. Bill Breimeier moved and Jayar Kindsvogel seconded the motion to approve Building Permit #1038. All in favor, none opposed; motion carried.

Discussion was held on Agricultural Permits. Lonnie Henke discussed that he does not want to see permit fees or application requirements for Agricultural buildings. Patty Koapke discussed the reasoning behind having ag permits and fees, because there has never been a set rule and some people have been required to do it while others have not, depending on who they were and who they knew. Permit fees with the current $100 for Agricultural were previously unanimously approved by both the Planning & Zoning Board and County Commission in September of 2023 as well as the revision of Permit fees in May of 2024. No action was taken at this meeting on this matter.

Solar Ordinance Amendment discussion was brought forth. County Commission Chair Lee Husfloen had requested of the Planning & Zoning department and board to look into Solar Ordinances throughout the state. Jody Reinke moved and Randy Schmidt seconded the motion to table discussion on Solar Ordinances. All in favor, none opposed; motion carried.

Jody Reinke moved and Jayar Kindsvogel seconded the motion to adjourn the meeting. All in favor, none opposed; motion carried. The meeting was adjourned at 8:21 pm.

The next meeting for the Oliver County Planning & Zoning Board will be June 27th at 7:00 pm in the Oliver County Courthouse Meeting Room.
