OLIVER COUNTY COMMISSION PROCEEDINGS were called to order at 8:00 AM with all members present.

 

Blake Wilkens moved and Darrell Berger seconded the motion to approve the agenda with additions. All in favor, none opposed; motion carried.

Darrell Berger moved and Blake Wilkens seconded the motion to approve the following bills for payment and approve the following bills previously paid. A roll call vote was held, with Darrell Berger, Blake Wilkens and Lee Husfloen all voting aye, none opposed. Motion carried.

Jay Volk, Summit Carbon Solutions, addressed the board to explain the company’s withdrawal of their Conditional Use Permits for consideration. Reasons behind this were due to the timing of the project with no construction happening this year, wanting to address concerns of the P&Z board and Commission as well as stating that the Planning & Zoning Board was “outside of their jurisdiction” in relation to conditions for the permits. Summit would like to sit down with the Commissioners to address the jurisdictional issues and other issues that followed the P&Z reasons for denial.

 

Darrell Berger moved and Blake Wilkens seconded the motion to approve the final terms of the Joint City/County Police Agreement with the 4% increase.

 

Kyle Miller, Road Superintendent, addressed road issues. The county may need a new track hoe. Mikael Schmidt asked the board about putting gravel on the approach near the Yucca Cemetery. The state would not put gravel down and said it was not their issue. It was damaged and hard to use after Minnkota put their powerline in. Kyle will speak to Minnkota about them repairing the damage. Troy Hatzenbiler addressed the board about damage done to his tractor when cutting the ditches on the Hensler road. The state left sign posts in the ground and the posts damaged his tires. Kyle will remove the sawed off posts if the state has not.

 

Terry Ternes, Mercer County Sheriff and temporary Oliver Mercer Emergency Manager and Rick Baumann, Mercer County Commissioner, addressed the Commission to discuss updates and changes to the EM position. Terry Ternes will serve as the temporary “Bridge” with the 911 Coordinator, Emergency Manager and the counties. Mercer County will host the office space for the position. The Commissioners requested that Mercer County will advertise for the position and include them in the hiring process.

 

The Commissioners opened the meeting to questions and comments from public in attendance.

Mike Haupt addressed the board and asked them to take safety concerns for CO2 pipelines and injection sites into consideration before making any decisions.

Daryn Karges, landowner, also discussed safety concerns of CO2 structures as well as the lasting impact it would have on the county and future generations.

Alan Maize also addressed safety concerns for CO2 structures and what an emergency response plan would look like.

Mikael Schmidt addressed the board, asking what the county would be leaving for future generations with CO2 structures in place and that it isn’t about the money.

 

Patty Koapke, Equalization Director, asked the Commissioners if Ryan Wrobbel could replace her office lights. The lights will be replaced on September 6th.

 

Jaden Schmidt, Auditor, presented the commission with Conditional Use Permit #1016 for Kent Albers for a Covered Feed Lot Operation in the SE ¼ of 32-143-84. Blake Wilkens moved and Darrell Berger seconded the motion to approve the Conditional Use Permit #1016. All in favor, none opposed; motion carried.

 

Jaden Schmidt, Auditor, presented the commission with Building Permit #1017 for Kent Albers for a hoop barn for the Covered Feed Lot in SE ¼ of Section 32-143-84. Blake Wilkens moved and Darrell Berger seconded the motion to approve Building Permit #1017. All in favor, none opposed; motion carried.

 

Jaden Schmidt, Auditor, presented the commission with Building Permit #1018 for Andrew Cochrane for a cabin and garage in N ½ of Section 30-143-81. Darrell Berger moved and Blake Wilkens seconded the motion to approve Building Permit #1017. All in favor, none opposed; motion carried.

Jaden Schmidt, Auditor, presented the commission with Building Permit #1021 for Patrick Bair for a 30 x 50 shop with an overhang in NE ¼ of Section 18-142-81. Darrell Berger moved and Blake Wilkens seconded the motion to approve Building Permit #10121. All in favor, none opposed; motion carried.

 

A Highway Utility Permit for WRT was presented to the Commission. Blake Wilkens moved and Darrell Berger seconded the motion to approved the permit. All in favor, none opposed; motion carried.

The Preliminary Budget Hearing will be held during the October 5th Commission Meeting. Jaden Schmidt, Auditor, handed out the NDACO salary survey.

 

Darrell Berger moved and Blake Wilkens seconded the motion to approved the new 911 NDACO fee schedule. All in favor, none opposed; motion carried.

 

The meeting adjourned at 10:03 AM.
