DECEMBER 2, 2021 OLIVER COUNTY COMMISSION PROCEEDINGS were called to order at 8:00 A.M. with all members present.

   Blake Wilkens moved and Darrell Berger seconded the motion to approve the agenda with the addition of Summit Carbon Solutions. All in favor, none opposed; motion carried.

     Darrell Berger moved and Blake Wilkens seconded the motion to approve the November 4, 2021 minutes as written. All in favor, none opposed; motion carried.

     Wade Boeshans, Summit Carbon Solutions, gave an update on the stratigraphic test wells. He mentioned they won’t be drilling the wells on the two permits they were approved for last month at this time. They will only be drilling the well that is before the commission at this meeting.

     Lonny Jacobson, EERC, talked about the drilling of the wells and mentioned the drilling should be completed by March. They are drilling two in Mercer County now and will be moving to Oliver County to drill next.

     Larry Dokken is in charge of the drilling side of the wells. He explained the process of drilling and noted it takes about 40 days working 24 hours/day for the project.

     Jeff Skaare, Summit Carbon Solutions, mentioned the well they are asking for approval on today is located south of Hazen about 9.9 miles in the NE ¼ of Section 6-142-86. He asked to widen an approach off 53rd Avenue to a valve set/pipe location.

     John Wicklund, Land Use Administrator, presented Conditional Use Permit #970 for Summit Carbon Solutions to drill a Stratigraphic Test Well in the NE ¼ of Section 6-142-86. Blake Wilkens moved and Darrell Berger seconded the motion to approve Conditional Use Permit #970 for Summit Carbon Solutions with the considerations/suggestions of the concerns of the public input at the Planning & Zoning meeting consisting of traffic/truck entering road signs near well site entrances along county roads, apply and incorporate into gravel roads a dust control product within 1000 feet of occupied residence driveways and provide dust control for livestock/animal protection, require road maintenance at discretion of the county road superintendent performed by Summit Carbon Solutions, landowners would like Summit Carbon Solutions to post an Irrevocable Letter of Credit in favor of Oliver County in a sum to cover any road damages that might be left in poor repair, and also add Oliver County as additionally insured on their general liability insurance policies and to provide evidence of permitting to drill the wells and storm water permitting. All in favor, none opposed; motion carried.

     John Wicklund, Land Use Administrator, presented Building Permit #971 for Nexius/AT&T to upgrade an existing cell tower in the SW ¼ of Section 17-142-83 and Building Permit #973 for Keith & Phyllis Grosz for a 50’ x 60’ shop in the SE ¼ of Section 12-143-87. Blake Wilkens moved and Darrell Berger seconded the motion to approve Building Permits #971 and #973. All in favor, none opposed; motion carried.

     Judith Hintz, Auditor, presented the 2021 Mill Levy Sheet and a handout from the NDDOT for a traffic count in Oliver County.

     Kasey Erickson, Butler Machinery, presented a quote for a New 150 AWD Caterpillar Motor Grader. The lease payment will be $49,625.48 for a 5 year lease. The quote also included an option to purchase a New Caterpillar Wing & Lift Group with installation for $22,120.00. Darrell Berger moved and Blake Wilkens seconded the motion to approve the lease of two 150 AWD Caterpillar Motor Graders for 5 years each and the purchase of one Caterpillar Wing & Lift Group. All in favor, none opposed; motion carried.

     Keith Kessler, Resident, asked to have an approach widened along 26th Street and 57th Avenue on a section line. Keith and Kyle Miller, Road Superintendent will discuss it further.

     Kyle Miller, Road Superintendent, discussed roads and blading.

     Blake Wilkens moved and Darrell Berger seconded the motion to approve the voting precincts with no change. The motion and second were then rescinded.

     The beer license/liquor license for the golf course for 2022 was discussed. Applications will go back to the applicant to be completed more thoroughly.

     There was discussion on the employee handbook.

     Darrell Berger moved and Blake Wilkens seconded the motion to approve the 2022 Commission Calendar with meetings being on January 6th, February 3rd, March 3rd, April 7th, May 5th, June 2nd, July 7th, August 4th, September 8th, October 6th, November 3rd, December 8th and December 29th. All in favor, none opposed; motion carried

   The meeting was adjourned at 10:28 A.M.

     The next meeting of the Oliver County Commission will be at 9:00 A.M., Wednesday, December 29, 2021 at the Oliver County Courthouse meeting room.
