April 2, 2020 OLIVER COUNTY COMMISSION PROCEEDINGS were called to order at 8:00 A.M. with all members present.

     Darrell Berger moved and Blake Wilkens seconded the motion to approve the agenda. All in favor, none opposed; motion carried.

     Blake Wilkens moved and Darrell Berger seconded the motion to approve the March 4, 2020 minutes as written. All in favor, none opposed; motion carried.

     Blake Wilkens moved and Darrell Berger seconded the motion to approve the Agreement for Removal of Scoria between Oliver County and Nathan Henke commencing on the 1st day of January, 2020 and expiring on December 31st, 2020. All in favor, none opposed; motion carried.

     Blake Wilkens moved and Darrell Berger seconded the motion to approve the county as a vote by mail county and the courthouse as the only polling place/vote center for the whole county due to the county being a vote by mail county for 2020 and going forward. All in favor, none opposed; motion carried.

     Blake Wilkens moved and Darrell Berger seconded the motion to approve the polling place start time as 8:00 A.M. This starting time is effective in the year 2020 and going forward. All in favor, none opposed; motion carried.

     Blake Wilkens moved and Darrell Berger seconded the motion to approve Lana Klindworth as the Inspector for the Primary election on June 9th, 2020. All in favor, none opposed; motion carried.

     Blake Wilkens moved and Darrell Berger seconded the motion to pay the election workers $10.00/hour plus provide a noon meal and an evening meal for them on election day. All in favor, none opposed; motion carried.

     Blake Wilkens moved and Darrell Berger seconded the motion to approve the Oliver County Resolution Regarding June 9th 2020 Primary Election Process.

    

     Oliver County Resolution Regarding June 9th 2020 Primary Election Process

 

The Oliver County Commission operating under their authority provided by NDCC § 16.1-04-02 & 16.1-11.1-01 and in consideration of the Governor’s declared emergency in response to the COVID-19 pandemic hereby declares by resolution that all previous County polling locations shall be eliminated for the June 9, 2020 primary election as allowed by the Governor’s executive order on March 26, 2020.

 

The County Commission further declares under their authority provided by NDCC § 16.1-11.1-01 to conduct the June 9th 2020 primary election by way of mail in ballot. The Commission encourages all qualified citizens to take every opportunity to vote by mail ballot prior to the June 9th 2020 Election.

     Darrell Berger moved and Blake Wilkens seconded the motion to approve a secured ballot box for outside the front of the courthouse to be purchased for collecting ballots that people would like to drop off at the courthouse instead of mailing. We will check with Center Machine Inc. about making one for us. All in favor, none opposed; motion carried.

     Blake Wilkens moved and Darrell Berger seconded the motion to approve the Health Emergency Declaration effective March 19th, 2020 due to COVID-19 stating a Health Emergency exists in Oliver County to include the incorporated City of Center. All in favor, none opposed; motion carried.

     Darrell Berger moved and Blake Wilkens seconded the motion to approve the Fire Emergency Declaration and Burn Ban Proclamation. All in favor, none opposed; motion carried.

     Judith Hintz, Auditor, presented the Mercer-Oliver 911/Emergency Manager Quarterly Report for October 1st – December 31st, 2019 for Carmen Reed, EM/911 Coordinator.

     Kacey Erickson, Butler Machinery, per phone call, discussed the Existing Lease Contract on the 938K Wheel Loader expires on 10/15/2020. He gave a quote on a Caterpillar 938M Wheel Loader. Lease would be for 60 months/2500 hours premier coverage at 4% annual interest unless the rate is lower at time of delivery, then the lower rate would apply. Annual payment would be $20,797.41. Darrell Berger moved and Blake Wilkens seconded the motion to approve the 5 - year lease for the Cat 938M Wheel Loader. All in favor, none opposed; motion carried.

     Judith Hintz, Auditor, mentioned Scott Harr with Twin City Roofing informed her if the weather holds out, they will be bringing two crews in mid April to work on the courthouse roof.

     Blake Wilkens moved and Darrell Berger seconded the motion to approve a Highway Utility Permit from WRT crossing county roads 30th Ave SW and 10th St SW, Center Exchange WO: 2020-269-001. All in favor, none opposed; motion carried.

     Kyle Miller, Road Superintendent, discussed roads and the Covid-19 Situation.

     Judith Hintz, Auditor, presented Building Permit #933. Darrell Berger moved and Blake Wilkens seconded the motion to approve Building Permit #933 for Ryan Zachmeier for a 24’ x 56’ Shop Building in the NW corner of the E ½ of the W ½ of Section 15-141-82. All in favor, none opposed; motion carried.

     Judith Hintz, Auditor, presented an email received from Dave Berger, Community Club, asking to use the courthouse courtyard and parking lot for various activities during Old Settler’s Days on June 12, 13, & 14th, 2020. He also asked for the county to pay for the Old Settler’s Dinner as in previous years. Darrell Berger moved and Blake Wilkens seconded the motion to approve the use of the courthouse courtyard and parking lot and for the county to pay for the Old Settler’s Dinner during Old Settler’s Days. All in favor, none opposed; motion carried.

     Judith Hintz, Auditor, presented Disabled Vets abatements for Parcel #02097001 for the years of 2017, 2018, and 2019. Darrell Berger moved and Blake Wilkens seconded the motion to approve the Disabled Vets abatements for Parcel #02097001 for the years 2017, 2018 and 2019. All in favor, none opposed; motion carried.
