March 4, 2020 OLIVER COUNTY COMMISSION PROCEEDINGS were called to order at 8:00 A.M. with all members present.

     Blake Wilkens moved and Darrell Berger seconded the motion to approve the agenda. All in favor, none opposed; motion carried.

     Darrell Berger moved and Blake Wilkens seconded the motion to approve the February 6, 2020 minutes as written. All in favor, none opposed; motion carried.

     Dwight Henke, Oliver County Resident, representing Miller Linn Post No. 90, asked the commission for approval to use the courthouse parking lot to burn flags on June 14th, 2020 which is also Flag Day. Darrell Berger moved and Blake Wilkens seconded the motion to approve Miller Linn Post No. 90 usage of the parking lot on June 14th, 2020. All in favor, none opposed; motion carried.

     No action was taken on updating the employee handbook at this meeting.

     Blake Wilkens moved and Darrell Berger seconded the motion to enter into a funding agreement for the 2021-2023 biennium to receive reimbursement for providing clerk of district court services with the North Dakota Supreme Court. All in favor, none opposed; motion carried.

     Darrell Berger moved and Blake Wilkens seconded the motion to approve the request for funding for the Oliver County Old Settlers Days Recognition and Candle-Lighting Remembrance Ceremony received from Jean Kautzman in the amount of $1,127.00. All in favor, none opposed; motion carried.

     Lee Husfloen, Chairman, mentioned Jay Volk, BNI, informed him the two bridges BNI have are under the county authority and the state wants them to stay with the county inspections. The county is to send an invoice to BNI after the bridges are inspected.

     Kyle Miller, Road Superintendent, stated road restrictions started today, March 4th, 2020.

     Bid opening was started at 8:30 A.M. with the opening of Fuel/Lubricants bids. Fuel/Lubricants bids were received from Rud Oil of Center. Darrell Berger moved and Lee Husfloen seconded the motion to accept all fuel/lubricant bids. All in favor, none opposed; motion carried. 8:40 A.M. Rental Equipment bids were received from Baranko Bros. of Dickinson. Blake Wilkens moved and Darrell Berger seconded the motion to accept all rental equipment bids. All in favor, none opposed; motion carried. 8:55 A.M. Gravel Crushing bids were received from Gravel Products, Inc., Sundre Sand & Gravel, Fisher Sand & Gravel, Knife River, and Aggregate Construction. Blake Wilkens moved and Darrell Berger seconded the motion to accept all gravel crushing bids. All in favor, none opposed; motion carried.

     Thomas VonBische, Nextera, presented two Road Use and Maintenance Agreements. One for the repowering of Oliver I and one for the repowering of Oliver II. Darrell Berger moved and Blake Wilkens seconded the motion to approve the Road Use and Maintenance Agreement for Oliver I. On roll call vote the following voted “Aye”: Blake Wilkens, Darrell Berger, and Lee Husfloen. None voted “Nay”. Motion carried. Darrell Berger moved and Blake Wilkens seconded the motion to approve the Road Use and Maintenance Agreement for Oliver II. On roll call vote the following voted “Aye”: Darrell Berger, Blake Wilkens, and Lee Husfloen. None voted “Nay”. Motion carried.

     Lee Husfloen exited the meeting at 9:15 A.M. Vice-Chairman Darrell Berger continued on with the agenda.

     John Wicklund, Land Use Administrator, presented Building Permit #932 for Mark Ellis to build a 24’ Yurt in Sanger in Section 30-143-81. Blake Wilkens moved and Darrell Berger seconded the motion to approve Building Permit #932. All in favor, none opposed; motion carried.

     The North Dakota Department of Environmental Quality is renewing the North Dakota Pollutant Discharge Elimination System General permit for construction stormwater discharges applicable to Project #CNOB-CNOC-3331(053). No action was taken at this time until we can review it with the county engineer.

     The meeting was adjourned at 10:05 A. M.
