February 6, 2020 OLIVER COUNTY COMMISSION PROCEEDINGS were called to order at 8:00 A.M. with Darrell Berger and Lee Husfloen present. Blake Wilkens was absent.
Darrell Berger moved and Lee Husfloen seconded the motion to approve the agenda. All in favor, none opposed; motion carried.

John Wicklund, Land Use Administrator, presented Conditional Use Permit #929 for Jacob & Elizabeth Gappert for a non-farm residence in the SW ¼ of Section 14-141-85 and Conditional Use Permit #931 for Minnkota Power for a well for exploration and data collection for CO2 Storage in the N ½ of Section 27-142-84. Darrell Berger moved and Lee Husfloen seconded the motion to approve Conditional Use Permits #929 and #931. All in favor, none opposed; motion carried.
John Wicklund, Land Use Administrator, presented Building Permit #930 for Jacob & Elizabeth Gappert for a Mobile Home in the SW ¼ of Section 14-141-85. Lee Husfloen moved and Darrell Berger seconded the motion to approve Building Permit #930. All in favor, none opposed; motion carried.
Darrell Berger moved and Lee Husfloen seconded the motion to approve Darrin Johnson, Nodak Insurance Company, as the agent to handle the counties North Dakota Fire & Tornado policy matters for the 2020-2021 coverage period. All in favor, none opposed; motion carried.
Darrell Berger moved and Lee Husfloen seconded the motion to approve the Joint Powers Agreement between the County of Oliver and the City of Center regarding the operation of the Enhanced 911 Communications Systems commencing on the 1st day of March, 2020 and expiring on the 28th day of February, 2021. All in favor, none opposed; motion carried.
The employee parking lot was discussed. The county road workers will try to fix the current drainage problem that exists.
Darrell Berger moved and Lee Husfloen seconded the motion to appoint Mike Tietz to the Water Management Board for a 3 year term ending 2022. All in favor, none opposed; motion carried.
Kyle Miller, Road Superintendent, discussed roads and cutting trees, and that he is looking at renting a stump grinder that will fit onto the skid steer.
Judy McNulty and Dave Berger discussed Hazel Miner and her heroic efforts to save her brother and sister from the freezing cold. They asked the Oliver County Commissioners to proclaim March 16th as Hazel Miner Day in Oliver County from 2020 and each year forward. Darrell Berger moved and Lee Husfloen seconded the motion to approve the Proclamation for Hazel Miner Day to be March 16th starting in 2020 and each year going forward. All in favor, none opposed; motion carried.
Thomas Klabunde, Moore Engineering, discussed SC-CNOC-3300(019). It was approved by the NDDOT and final paperwork is being completed. He also discussed the bridge inspections.
Darrell Berger moved and Lee Husfloen seconded the motion to approve the Bridge Inspection and Load Rating Services Agreement between Oliver County and the NDDOT and or/a consultant engineering firm hired by NDDOT. All in favor, none opposed; motion carried.
Darrell Berger moved and Lee Husfloen seconded the motion to approve two applications for Abatement or Refund of Taxes. Parcel #08070002 was for a retired farmer exemption for the years 2017, 2018 and 2019 and Parcel #02097002 was for Disabled Veterans Credit for the years 2017, 2018 and 2019. All in favor, none opposed; motion carried.
The employee handbook was discussed. No action was taken at this time.
Jay Volk, BNI, discussed the MDU reroute. He said they are still working on it but a proposed route would have no poles closer than 60’ to the right of way. Darrell Berger moved and Lee Husfloen seconded the motion to consent to poles being placed in the S ½ of Section 29-T141N-R83W which would be within 75’ (70 ft) for one mile and the South ½ of Section 22 and SE ¼ of Section 21 (60’) – T141N - R84W for one and a half miles.
Darrell Berger moved and Lee Husfloen seconded the motion to approve the 2020 Software Support and License Renewal Agreement with Software Innovations. All in favor, none opposed; motion carried.
