October 8, 2020 OLIVER COUNTY COMMISSION PROCEEDINGS were called to order at 8:00 A.M. with all members present.
Blake Wilkens moved and Darrell Berger seconded the motion to approve the agenda. All in favor, none opposed; motion carried.

Darrell Berger moved and Blake Wilkens seconded the motion to set the minimum bid price for Parcel #25274000 Lot 11 Block 3 Bergers 3rd Addition at $411.97, Parcel #25168000 Lot 4 East ½ Lot 5 Block 2 Hagerotts Addition at $745.51, and Parcel #25176000 Lots 4-5-6 Block 3 Hagerotts Addition at $ 7,600.90 which became the property of the county on October 1st, 2020. The sale will take place on November 17, 2020 at 10:00 A.M in the courthouse meeting room if the former owners do not pay the taxes by 4:00 P.M. on November 16, 2020. Blake Wilkens moved and Darrell Berger seconded the motion to raise the maximum amount on the credit cards for Oliver County to $15,000.00 with the amount of credit on each card as follows: 3 cards for Deputy Sheriff’s at $1,000.00 each, 1 card for Sheriff at $1,000.00, 1 card for Road Superintendent at $5,000.00 with Judith Hintz, Auditor, working with the bank on credit card decisions and issues. All in favor, none opposed; motion carried.
Darrell Berger moved and Blake Wilkens seconded the motion to appoint Lee Husfloen as the delegate for Oliver County at the virtual NDACo conference on October 12th and 13th, 2020. All in favor, none opposed; motion carried.
Blake Wilkens moved and Darrell Berger seconded the motion to appoint Rita Giesen as the Inspector at the Vote Center for all 7 precincts for the General Election on November 3, 2020. All in favor, none opposed; motion carried.
Lee Husfloen will be attending the Coal Conversion Counties annual meeting on October 28th, 2020.
Judith Hintz, Auditor, presented the Mercer-Oliver 911/Emergency Manager Quarterly Report for the months of July 1st, 2020 – September 30th, 2020.
The I Wave Air Purifier was discussed. The cost of the purifier’s is $1,850.00.
Rebecca Wrobbel, Oliver County Resident, presented signatures from people in favor of a wind moratorium and discussed how the wind energy affects the coal mines and power plants.
Jim Jackson, Moore Engineering, discussed the Final Project Certification – HB 1176 for Project CNOC-0033(005) PCN 21744 and for HB1176 Project SC-CNOC-3300(019) PCN 22447. Blake Wilkens moved and Darrell Berger seconded the motion to approve the Final Project Certification for those two projects. All in favor, none opposed; motion carried.
Blake Wilkens moved and Darrell Berger seconded the motion to approve the County Federal Aid Program for 2021 with a Base 1 and Double Chip Seal on CMC 3310 from State Hwy 31 to CMC 3311 with a bid date of 2022 and Patching, Mill, and Overlay on CMC3325 from State Hwy 25 south 3.5 miles with a bid date of 2026. All in favor, none opposed; motion carried.
John Wicklund, Land Use Administrator, presented Conditional Use Permit #942 for Cody Helmers for a non-farm residence in the SE ¼ of Section 28-143-83. Blake Wilkens moved and Darrell Berger seconded the motion to approve Conditional Use Permit #942. All in favor, none opposed; motion carried.
John Wicklund, Land Use Administrator, presented Building Permit #943 for Cody Helmers for a Mobile Home in the SE ¼ of Section 28-143-83. Darrell Berger moved and Blake Wilkens seconded the motion to approve Building Permit #943. All in favor, none opposed; motion carried.
John Wicklund, Land Use Administrator, presented Building Permit #944 for Great River Energy to rebuild the existing 230KB Transmission Line in Sections 3, 10, 11, 14, 23, 24, 25 & 36 – 143-84, Section 1 -144-84, and Sections 6, 7, 17, 18, 20, 28, 29 & 33 142-83. Blake Wilkens moved and Darrell Berger seconded the motion to approve Building Permit #944. All in favor, none opposed; motion carried.
Blake Wilkens moved and Darrell Berger seconded the motion to allow a variance for Michael Berg to plant trees to line up with another tree row in Section 2-143-85, with it being the owners expense to remove the trees if ever needed. All in favor, none opposed; motion carried.
Darrell Berger moved and Blake Wilkens seconded the motion to approve the Road Use & Maintenance Agreement for Oliver Wind I and Oliver Wind II releasing the Wind Operator of any further obligations for the roads under the agreement. All in favor, none opposed; motion carried.
Kyle Miller, Road Superintendent, discussed roads, gravel and a quote from Swanston Equipment Companies on a Demo 60” Diamond Skid-Steer Drum Mulcher for $26,835.00. Darrell Berger moved and Blake Wilkens seconded the motion to purchase the Demo 60” Diamond Skid-Steer Drum Mulcher from Swanston Equipment Companies. All in favor, none opposed; motion carried.
Blake Wilkens moved and Darrell Berger seconded the motion to approve Richard Schmidt as the State Fair Delegate. All in favor, none opposed; motion carried.
An email from Kristine Braun, Planning and Environmental Coordinator, Bureau of Land Mangement was discussed.
Judith Hintz, Auditor, presented a letter from NDDOT requesting the counties assistance to identify locations within the jurisdiction where rail/highway crossing safety could be improved.
Darrell Berger moved and Blake Wilkens seconded the motion to approve Resolution 2020-02 which is a resolution approving mail ballots and a vote center for the 2020 General Election and Future Elections. All in favor, none opposed; motion carried.
Blake Wilkens moved and Darrell Berger seconded the motion to change the November Commission Meeting from November 5th to November 12th, 2020. All in favor, none opposed; motion carried.
James Schwab, Oliver County resident, asked the county about having an ordinance for engine brakes on Hwy 25 past his residence in Hannover.
The final budget hearing convened at 10:30 A.M. All department budgets were reviewed and finalized as follows:

Full-time employees will receive $1,300.00 a year salary increase with part-time employees being prorated for the year 2021. Commissioners will receive $650.00 a year salary increase for the year 2021. The General Fund mills will be decreased from 13.00 to 10.00, Emergency mills will be .12, Road & Bridge .25 and Weed Board at 3.1 mills. The commission is asking all departments to decrease their spending for 2021 by 5% from what was approved. Darrell Berger moved and Blake Wilkens seconded the motion to approve the 2021 budget as revised. Roll call vote: Darrell Berger – Aye, Blake Wilkens – Aye, Lee Husfloen – Aye. Motion carried.
