NOVEMBER 4, 2021 OLIVER COUNTY COMMISSION PROCEEDINGS were called to order at 8:00 A.M. with all members present.
Blake Wilkens moved and Darrell Berger seconded the motion to approve the agenda with the addition of Daryn Karges. All in favor, none opposed; motion carried.

Carmen Reed, Emergency Manager/911 Coordinator, presented the quarterly reports for July 1st – September 30th, 2021. She also presented a quote from Electronic Communications for $26,764.00 for a new repeater, duplexer and coax and antennaes. A motion was made last month for these to be installed. The county is asking the school to pay $5,000.00 on the cost of these repairs.
Darrell Berger moved and Blake Wilkens seconded the motion to sign a letter of support for the City of Center’s proposed walking trail. The county is supporting the proposed walking trail but is not providing financial support. All in favor, none opposed; motion carried.
Darrell Berger moved and Blake Wilkens seconded the motion to allow employees diagnosed with covid for 2021 to stay home and be paid without using sick leave or vacation hours. They need to show the results of a positive test or if they were in close contact with a person diagnosed with covid, then they need the Department of Health advising them to stay home. All in favor, none opposed; motion carried.
Judith Hintz, Auditor, presented the budget analysis for the 2022 budget.
Wade Boeshans, Executive Vice President of Summit Carbon Solutions, discussed the Conditional Use Permits applied for to drill a stratigraphic test well. Daryn Karges, Josh Dukart, Dave Porsborg, and Kurt Swenson discussed the project. Some mentioned they were not opposing the project but wanted to protect the rights and freedoms of the landowners and were asking the commission to consider the views of the landowners. Some also asked for the commission to “tap on the brakes” until more information is gathered. Dan Bueligen discussed when the transmission line went past his residence and the damage to the roads, section lines and yards. Kurt Swenson mentioned having Summit Carbon Solutions post an Irrevocable Letter of Credit in favor of Oliver County in a sum to cover any road damages.
John Wicklund, Land Use Administrator, presented Conditional Use Permit #966 for Summit Carbon Solutions to drill a Stratigraphic Test Well in the NE ¼ NW ¼ of Section 36-143-86 and Conditional Use Permit #967 for Summit Carbon Solutions to drill a Stratigraphic Test Well in the SE ¼ NW ¼ of Section 36-141-86. Blake Wilkens moved and Lee Husfloen seconded the motion to approve Conditional Use Permit #966 and Conditional Use Permit #967 for Summit Carbon Solutions with the considerations/suggestions of the concerns of the public input at the Planning & Zoning meeting consisting of traffic/truck entering road signs near well site entrances along county roads, consider restricting hours of operation when possible to daylight hours, apply and incorporate into gravel roads a dust control product within 1000 feet of occupied residence driveways and provide dust control for livestock/animal protection, require road maintenance at discretion of the county road superintendent performed by Summit Carbon Solutions, landowners would like Summit Carbon Solutions to post an Irrevocable Letter of Credit in favor of Oliver County in a sum to cover any road damages that might be left in poor repair, and also add Oliver County as additionally insured on their general liability insurance policies and to provide evidence of permitting to drill the wells and storm water permitting. Roll call vote: Blake Wilkens – Aye, Darrell Berger – Nay, Lee Husfloen – Aye. Motion Carried.

Blake Wilkens moved and Darrell Berger seconded the motion to approve Building Permits #968 and #969. All in favor, motion carried.
