Blake Wilkens moved and Darrell Berger seconded the motion to approve the E-911 Joint Powers Agreement between the County of Oliver and the City of Center regarding the operation of the Enhanced 911 Communications Systems commencing on the 1st day of March, 2022 and expiring on the 28th day of February, 2023. All in favor, none opposed; motion carried.

Blake Wilkens moved and Darrell Berger seconded the motion to approve a Highway Utility Permit for Kennie & Darlene Voegele along or crossing county road 34th Ave SW and 22nd St SW. All in favor, none opposed; motion carried.
John Wicklund, Land Use Administrator, presented Conditional Use Permit #972 for BNI Coal for excavation, coal mining, and associated disturbances. Karene Hall & Derrick Placek, BNI were in attendance. Blake Wilkens moved and Darrell Berger seconded the motion to approve Conditional Use Permit #972. All in favor, none opposed; motion carried.
Keith Kessler, Oliver County Resident, brought up concerns about the setback for wind towers. He mentioned wind towers are larger than when the ordinance was written so he would like to see the guidelines for set backs on wind towers revised.
Kasey Erickson, Butler Machinery, presented a quote for a Massey-Ferguson Model #MF7715S MFWD Tractor. Blake Wilkens moved and Darrell Berger seconded the motion to approve leasing for a 5 year lease with 5 annual payments of $9,502.50 per year with buyout of $82,880.29 due in May of 2027 if the county wishes to purchase it at that time. All in favor, none opposed; motion carried.
Darrell Berger moved and Blake Wilkens seconded the motion to allow employees diagnosed with covid for 2022 to stay home and be paid without using sick leave or vacation hours. They need to show the results of a positive test or if they were in close contact with a person diagnosed with covid, then they need the Department of Health advising them to stay home. All in favor, none opposed; motion carried.
Jason Skaare, Summit Carbon Solutions, discussed their ongoing project. There was concerns about dust control. Mr. Skaare said Summit Carbon Solutions will keep up on dust control if the county lets them know there is a problem. Judith Hintz, Auditor, mentioned to Mr. Skaare she had a request from an Oliver County resident for copies of permits they were to have gotten. Mr. Skaare said he could get the county copies.
Kyle Miller, Road Superintendent, discussed roads. He also discussed the boiler room drains not functioning properly. The road workers did what they could with the drains but we will need to have a plumber take a look at them.
Patricia Koapke, Tax Director, presented an abatement for economic obsolescence for Parcel #25421001 for the years 2020 and 2021. Darrell Berger moved and Blake Wilkens seconded the motion to approve an abatement for Parcel #25421001. All in favor, none opposed; motion carried.
Patricia Koapke, Tax Director, presented an abatement for a farm exemption for Parcel #10070001 for the years 2020 and 2021. Darrell Berger moved and Lee Husfloen seconded the motion to approve an abatement for Parcel #10070001. All in favor, none opposed; motion carried.
Patricia Koapke, Tax Director, presented an abatement for a residence in the flood zone for Parcel #25393007 for the year 2021. Darrell Berger moved and Blake Wilkens seconded the motion to approve an abatement for Parcel #25393007. All in favor, none opposed; motion carried.
Darrell Berger moved and Blake Wilkens seconded the motion to enter into a funding agreement for the 2023-2025 biennium to receive reimbursement for providing clerk services. All in favor, none opposed; motion carried. Judith Hintz, Oliver County Auditor, will send a letter to the ND Supreme Court to notify them of this motion.
Judith Hintz, Auditor, presented an email from Job Service ND offering an outreach service to the businesses and job seekers of Oliver County where they would come into the community one day a month to offer in person service. They were wondering about a location. The commission asked the auditor to forward the email to the City Auditor as it may work better to have this in the Civic Center.
Board pay for meetings was discussed. The commission will look over the paperwork the auditor presented on what other counties in the state are paying for board meetings and make a decision at their March 1, 2022 meeting.
